An application to demolish and replace the 1940s Brick Bungalow with classic Leaside features at 33 Randolph Road, with TWO new buildings ie. a 2-Storey House plus a 2-Storey Garden Suite measuring 20ft x 22ft x 20ft (height is like a 3-storey building as it’s on an elevated plot), and also a Swimming Pool, rendering the place with hardly any green, as well as potentially wiping out an Award Winning Garden in the adjacent neighbor’s front yard.

Fact: Half of the garden relies on sunlight coming from the rear will be completely BLOCKED by the egregious building proposition.

Killing Matured Tree (Foundation Excavation/Root Cutting)
The proposed Garden Suit may also kill a healthy 50-60ft tall matured Blue Spruce in our Front Yard, because some 40% of the roots will be removed/injured since the proposed 3m Tree Protection ZONE (TPZ) only covered approx. 60% of the required distance. (See 5. b) Urban Forestry By-Laws below)
Please help to save the precious green from the egregious proposition by disseminating this news far and wide.
Most important of all, please WRITE to the Committee of Adjustment expressing your Objection before 4 p.m. on April 4th , 2024.
The North York Committee of Adjustment will Decide whether to approve, reject or modify the application for 15 types of Variances being requested during the Hearing on April 11th, 2024.

a) Zoning By-law 569-2013
Approval is sought for 15-16 Variances, mostly Major and downright absurd (See CA Public Notice for downloadable details/drawings — link above).
b) Urban Forestry By-Laws
3. & 4. Above refers. For example, the Spruce Tree (marked as Tree A 3m TPZ in Arborist Report) requires a 4.2m Protection Barrier (TPZ). Because the Tree Trunk Diameter is 75.5” and Not 50’ as they Falsely declared (stated with “EST” [Estimate] as Caveat) with a Deficient 3m TPZ. The proposed “Garden Suit” therefore violated at least the Street Tree By-law, City of Toronto Municipal Code Chapter 813, Article II.
c) Public Safety Risks
i. Fire Hazards To The Neighborhood
The ‘Garden Suit’ extends all the way to the fence, whereas Building Code/Fire Code dictate any wall less than 1.2m from the border is a Fire Hazard (proposed 0.96m, other setback only 0.58 – 0.91m). Also not only Stucco is never a Leaside character whereby the fire resistance level is also relatively low compared to say, Bricks.
The proposed buildings have violated all safety law at all levels including but not limited to:-

ii. Traffic/Pedestrian Hazards
The proposed twin-garage is posing life/injury risks as vehicles/pedestrians turning from Randolph Road into Rutherglen Road wouldn’t be able to see cars egressing from the proposed house… Again, violated all safety laws and Sightline Obstruction bylaw, and § 950 (Traffic), § 447 (Fences), § 743 (Street & Sidewalk), and § 629 (Property Standard) etc.
